1. About these terms
This website, evenwarm.com, is operated by Cohen Vandiver, doing business as Evenwarm ("Evenwarm," "we," "us" or "our"). These Terms of Service apply to your use of the site and to every purchase you make from us. By using the site or placing an order, you agree to these terms, our Return & Refund Policy, our Shipping Policy and our Privacy Policy. If you don't agree, please don't use the site.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that the information you give us is accurate and that you're authorized to use your payment method.
3. Products
Evenwarm massagers are personal comfort devices, not medical devices. They aren't intended to diagnose, treat, cure or prevent any disease or condition. Nothing on this site is medical advice. Read our Safety Information before use, and ask your doctor before using a massager if you are pregnant, have a pacemaker or other implanted device, have a medical condition, or are under medical care.
We try to show product colors, sizes and features accurately. Colors may look slightly different on your screen.
4. Prices and payment
Prices are in US dollars and can change at any time without notice. Bundle savings are applied automatically in the cart and are calculated from the single-unit price. Promotions can't be combined unless we say so.
We accept the payment methods shown at checkout. Payments are processed by Shopify and its payment partners. We never see or store your full card number.
5. Orders
Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel any order, for example if a product is unavailable, a price was listed in error, or we suspect fraud. If we cancel an order you've paid for, we'll refund you in full.
If we find a pricing or listing error after you order, we'll contact you. You can then confirm the corrected order or cancel it for a full refund.
6. Shipping and risk of loss
We ship to US addresses as described in our Shipping Policy. Delivery times are estimates. If your package is lost or damaged in transit, we'll replace it or refund you as described in that policy.
7. Returns, refunds and warranty
Returns and refunds follow our Return & Refund Policy. Each massager comes with a 12-month limited warranty against manufacturing defects. The warranty doesn't cover normal wear, misuse, water damage, accidents, or damage from using a charger other than the one included. Your sole remedy under the warranty is repair, replacement or a refund, at our choice.
8. Disclaimer
Except for the limited warranty above, and to the fullest extent permitted by law, the site and our products are provided "as is." We disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states don't allow these disclaimers, so they may not apply to you.
9. Limitation of liability
To the fullest extent permitted by law, Evenwarm won't be liable for any indirect, incidental, special or consequential damages arising from your use of the site or our products. Our total liability for any claim related to a product won't exceed the amount you paid for that product. Nothing in these terms limits liability that can't be limited by law, including for personal injury caused by our negligence.
10. Safe use
You agree to use our products as described in the included instructions and our Safety Information. Don't use a massager while sleeping or driving, on broken or inflamed skin, on the front of the neck, near water, or while it's charging.
11. Acceptable use of the site
You agree not to misuse the site, including by:
- breaking any law, or helping someone else to;
- placing fraudulent orders or using a payment method you're not authorized to use;
- trying to hack, disrupt or overload the site;
- scraping or copying site content for commercial use without our permission;
- posting reviews or messages that are false, abusive or infringe someone else's rights.
12. Reviews and messages
If you send us a review, photo or feedback, you give us permission to use it, without payment, to run and promote Evenwarm. You confirm it's yours and truthful. We don't edit reviews to change their meaning.
13. Intellectual property
The Evenwarm name, logo, website design, text and images belong to us or our licensors. You may not use them without our written permission.
14. Third-party services
The site uses third-party services such as Shopify, payment processors, shipping carriers and our fulfillment partner. Their own terms and privacy policies apply to how they handle your information. We're not responsible for third-party websites we link to.
15. Privacy
Our Privacy Policy explains how we collect and use your personal information.
16. Governing law and disputes
These terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-law rules. If you have a problem, please email us first. Most issues are solved quickly that way. Any dispute that can't be resolved informally will be handled in the state or federal courts located in Oregon, unless the law where you live gives you the right to bring it elsewhere. Either party may bring a qualifying claim in small claims court.
17. Changes to these terms
We may update these terms from time to time. The "Last updated" date shows the latest version. The terms in effect when you place an order apply to that order.
18. Severability
If any part of these terms is found unenforceable, the rest stays in effect.
